CMS Appeals Ruling That Invalidated 2014 MA Overpayment Rule

CMS is appealing a federal judge’s decision to strike down a 2014 rule that established a strict definition of overpayments in Medicare Advantage and required MA plans to return those overpayments to CMS. The agency filed the appeal on Tuesday (Nov. 13) with the U.S. Court of Appeals for the D.C. Circuit, and arguments are expected in the coming months.
