HHS says the American Hospital Association's suggestions for decreasing the backlog at the third level of Medicare appeals aren't workable, and argues the court shouldn't get involved at this point because the agency's policies are starting to shrink the backlog without any intervention. HHS had advanced a number of policies to reduce the backlog.
