HHS Proposed Rule Touts Less ‘Trial-Like’ Process For 340B Disputes

340B hospitals are pleased with the changes to the administrative dispute resolution process HHS proposed in a new rule released Tuesday (Nov. 29), particularly those that would make the process less formal and less like legal proceedings. The Health Resources and Services Administration released changes to the controversial ADR process that would revise a December 2020 rule on how administrative dispute resolutions for diversions, duplicate discounts, and overcharges under the program should be handled.
