A federal appeals court upheld Medicare’s long-standing policy of prohibiting drug copay assistance and charity, notching a win for insurers and a loss for drug makers. It’s common for drug companies to help people pay what their insurance doesn’t cover for drugs either with copay coupons or through charities, but the government says those arrangements violate anti-kickback law because they induce patients to pay for expensive brand name drugs.
