Appeals Court Sides With PBMs In Challenge To North Dakota Law

A federal appeals court on Friday (Aug. 7) voided a North Dakota law that limits the fees pharmacy benefit managers can charge pharmacies and ruled that the law is preempted by the federal Employee Retirement Income Security Act (ERISA). The lawsuit, Pharmaceutical Care Management v. Mylynn Tufte , is over a 2017 law that lets the state limit copayments and dictate the metrics PBMs and third-party payers may use to evaluate pharmacies and reward or punish performance.
