Supreme Court To Hear Case On CMS’ Rulemaking Authority In January

A case that could define the extent of CMS’ authority to issue legal interpretations without conducting notice-and-comment rulemaking will be argued before the Supreme Court on Jan. 15. The justices decided in September to take the case , but the date for oral argument was not set until this week when the court released its January schedule.
