Recent Rulings Will Complicate No Surprises Arbitration, Attorney Says

Health care lawyers tracking implementation of the No Surprises Act (NSA) say the recent court decision to throw out pieces of the Biden administration’s final rule on the independent dispute resolution (IDR) process has left the arbiters with little guidance on how to make payment decisions and will likely result in longer, costlier disputes.
