The White House budget office is reviewing an FDA proposed rule that clarifies what kind of evidence the agency will consider when determining a product’s intended use. FDA attempted to amend the definition three years ago by tucking the changes into a larger tobacco rule, but it then nixed the move after receiving pushback from Republican lawmakers and industry stakeholders.
