GOP Probe Of FTC Post-Chevron May Put Breach Notification Rule In Spotlight

House committee leaders on Thursday (July 18) asked the Federal Trade Commission to identify regulatory efforts vulnerable to litigation due to the Supreme Court’s removal of its Chevron deference to agencies’ interpretations of vague statutes -- a move that may brighten the spotlight on FTC’s expansion of it privacy breach notification rule to health data not covered by the Health Insurance Portability and Accountability Act.
