The Fifth Circuit of Appeals Friday (Aug. 2) upheld a lower court decision to vacate nationwide the Biden administration’s guidance to independent entities on how to determine the winner of payment fights under the No Surprise Act -- a ruling that did not rely upon but was still bolstered by the Supreme Court’s recent decision to ax Chevron deference.
