Court Sides With Pharma, Tosses Out Trump Admin DTC Ad Rule

A federal court on Monday (July 8) threw out the Trump administration’s rule requiring drug makers to disclose list prices in television advertisements because the judge found regulating television ads for prescription drugs is outside CMS’ authority. The rule was set to be enacted on July 9. U.S. District Court for the District of Columbia Judge Amit Mehta wrote that HHS lacks the statutory authority to regulate television advertisements under the Social Security Act.
