CMS Revises Home And Community Services Guidance To Avoid 'Infinite Penalty'

CMS revised a Medicaid policy so that certain beneficiaries can eventually be eligible for institutional-level care in their homes after facing a penalty for cheaply selling off their assets, rather than face an unintended “infinite penalty” that keeps them from receiving services. Some attorneys following the issue said the revisions are well intended but could still pose some complications for those in states that have wait lists for receiving care under such a waiver.
