Admin Plans Listening Session On Provider Nondiscrimination Rule

The Biden administration will hold a listening session Jan. 19 to hear stakeholders’ thoughts on an upcoming rule implementing the Affordable Care Act’s provision that bars health plans from discriminating against providers yet not does require insurers to contract with any willing provider. The departments have considered the provision self-implementing and have not enforced it since 2015, but Congress required HHS, Treasury and Labor to promulgate regulations as part of the Consolidated Appropriations Act of 2021.
