Administration Wins One, Loses Another Insurance Court Case

The U.S. Court of Appeals for D.C. ruled July 1 that the administration overstepped its bounds in issuing regulations addressing “fixed indemnity” insurance. Insurance lawyer William Schiffbauer said that Central United Insurance Co. v. Burwell, et al involved the rule requiring issuers to obtain an “attestation” from the customer saying that he or she has minimum essential coverage before they can purchase a fixed indemnity supplemental policy.
