HHS Proposes To Let Attorneys Handle Certain Appeals At ALJ Level

HHS wants to let government attorneys make certain decisions at the third level of appeals and to allow the Departmental Appeals Board to designate certain decisions as precedents. Chief Administrative Law Judge Nancy Griswold and DAB Chair Constance Tobias estimate that these changes, along with funding increases and legislative proposals included in President Barack Obama's fiscal 2017 budget, could help eliminate the backlog of appeals by fiscal 2021.
