E&C Republicans Warn Burwell Against Using DOJ Fund To Settle Risk Corridor Suits

House Energy & Commerce Republicans warned HHS Secretary Sylvia Burwell on Tuesday (Sept. 20) that the department would circumvent Congress if it draws from a little-known Justice Department judgment fund to settle insurers' lawsuits over the lower-than-expected risk corridor payments. CMS told insurers in a Sept. 9 memo it was open to settling the suits but didn't elaborate.
