CMS Pressed To Ban Nursing Home Arbitration Pacts; AHCA Cries Foul

Shortly before the White House budget office began reviewing a final CMS rule updating Medicare and Medicaid requirements for participation for long term care facilities -- namely nursing homes -- consumer groups urged the agency to add language explicitly banning pre-dispute arbitration clauses in nursing home contracts. Consumer advocates and House Democrats complained the rule's requirements surrounding the pacts had the effect of tacitly legitimizing them, but the skilled nursing home lobby argues CMS lacks authority to ban voluntary arbitration...
